APPLICANT REQUESTS THAT:

His DD Form 214, Certificate of Release or Discharge from Active 
Duty, be corrected to include the award of the Southwest Asia 
Service Medal (SWASM).


APPLICANT CONTENDS THAT:

He was discharged during Operations DESERT SHIELD/STORM and 
requires this correction to further prove his eligibility for a 
Veteran Recruitment Appointment (VRA). 

The reason this request is submitted outside the three year window 
is because he is currently an Army civilian and applied for a VRA 
appointment as told by the Army Inspector General that this Medal 
is needed to avoid confusion as to his VRA status.

In support of his request, the applicant has provided a copy of 
his DD Form 214 which states he served in support of Operation 
DESERT SHIELD/STORM.

The applicant’s complete submission, with attachments, is at 
Exhibit A.


STATEMENT OF FACTS:

The applicant initially entered the Regular Air Force on 28 Dec 
83.

On 6 Jan 92, the applicant was furnished an Honorable discharge, 
and was credited with 8 years and 10 days of active service.   

The applicant’s DD Form 214 reflects no Foreign Service.  The 
following Air Force Medals and/or Ribbons are listed:

	- NCO Professional Military Education Graduate Ribbon
	- National Defense Service Medal
	- Air Force Training Ribbon
	- Air Force Longevity Service Award with one Bronze Oak Leaf 
Cluster
	- Air Force Good Conduct Medal with one Bronze Oak Leaf Cluster

The remaining relevant facts pertaining to this application are

primary responsibility (OPR), which is attached at Exhibit C.    


AIR FORCE EVALUATION:

AFPC/DPSID recommends denial indicating there is no evidence of an 
error or an injustice.  

After a thorough review of the applicant’s official military 
record, they were unable to verify the applicant served any 
Foreign Service for the award of the SWASM.  According to the 
applicant’s DD Form 214, he was not credited with completion of 
any Foreign Service while on active duty.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant 
on 14 Nov 14 for review and comment within 30 days (Exhibit D).  
As of this date, no response has been received by this office.


THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing 
law or regulations.

2.  The application was not timely filed; however, it is in the 
interest of justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been presented to 
demonstrate the existence of an error or injustice.  We took 
notice of the applicant’s complete submission in judging the 
merits of the case; however, we agree with the opinion and 
recommendation of the Air Force office of primary responsibility 
(OPR) and adopt its rationale as the basis for our conclusion the 
applicant has not been the victim of an error of injustice.  
Therefore, in the absence of evidence to the contrary, we find no 
basis to recommend granting the requested relief.






THE BOARD DETERMINES THAT:

The applicant be notified the evidence presented did not 
demonstrate the existence of material error or injustice; the 
application was denied without a personal appearance; and the 
application will only be reconsidered upon the submission of newly 
discovered relevant evidence not considered with this application.
